Terms of Service | Sonah Elevate

1. Acceptance of Terms

By accessing or using Sonah Elevate ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service. These Terms apply to all users, including individual users and organizations.

2. Description of Service

Sonah Elevate is a construction project management platform that provides tools for managing RFIs, submittals, deficiencies, schedules, documents, and team collaboration. We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time.

3. Account Registration

You must provide accurate and complete registration information
You are responsible for maintaining the security of your account credentials
You must notify us immediately of any unauthorized access
You are responsible for all activities under your account
One person or entity per account; no sharing accounts

4. User Responsibilities

You agree not to:

Use the Service for any illegal purpose
Upload content that infringes intellectual property rights
Transmit malware, viruses, or harmful code
Attempt to gain unauthorized access to our systems
Interfere with other users' use of the Service
Use automated systems to access the Service without permission
Share login credentials with unauthorized parties

5. Payment Terms

Billing: Subscription fees are billed in advance on a monthly or annual basis.

Payment Methods: We accept major credit cards and ACH transfers for annual plans.

Refunds: Annual subscriptions may be eligible for prorated refunds within 30 days. Monthly subscriptions are non-refundable.

Price Changes: We will provide 30 days notice of price changes.

6. Intellectual Property

Our Property: The Service, including all software, designs, and content created by us, is owned by Sonah AI and protected by intellectual property laws.

Your Content: You retain ownership of content you upload. By uploading content, you grant us a license to host, store, and display it as necessary to provide the Service.

7. Data and Privacy

Your use of the Service is also governed by our Privacy Policy. You acknowledge that we may collect and use data as described in the Privacy Policy.

8. Disclaimers

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT GUARANTEE UNINTERRUPTED OR ERROR-FREE SERVICE.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SONAH AI SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR LOSS OF PROFITS, DATA, OR GOODWILL. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT PAID BY YOU IN THE TWELVE MONTHS PRECEDING THE CLAIM.

10. Termination

Either party may terminate this agreement at any time. We may suspend or terminate your access for violation of these Terms. Upon termination, your right to use the Service ceases immediately. You may export your data before termination.

11. Governing Law

These Terms are governed by the laws of the State of California, without regard to conflict of law principles. Any disputes shall be resolved in the state or federal courts located in San Francisco County, California.
